A federal IRS requirement for employers, effective January 1st 2015, mandates that any employee who is rehired with their group:

                Within 26 weeks for an education group or

                Within 13 weeks for any other group of their termination date, has an immediate effective provision (as of their date of rehire). A probationary period or effective provision is not applicable. Once rehired within the aforementioned timeframes, the employee can be reinstated into their previous benefits or reselect benefits to enroll into.

 

Rehired Within 31 Days:

An employee who is rehired with their group within the first 31 days of termination date can be reinstated into their previous benefits. The group can request a break or lapse in coverage for a rehired member (from the day they have been terminated to the day they are rehired) but a probationary period or effective provision is not applicable.

 

Point to Note: Humana must receive notification of a rehire within 31 days of their rehire date.  If a rehire notification is not received within 31 days of the employee’s rehire date, the member is considered late and all standard late enrollee rules would apply.

 

Rehired After 13 Weeks BUT Within 12 Months:

When an employee is rehired with their group: after 26 weeks for an education group, or 13 weeks for all other groups, but within the 12 months following their termination date, the following rules apply (in this order):

1)      Group rehire rules, when applicable

2)      The group can request to waive the probationary waiting period. In these cases, the rehire date becomes the effective date of coverage and the enrollment is processed with the same benefits as previously enrolled.

 

Point to Note: If the group does not request to waive the probationary period, then all new hire rules will apply and the member can select whichever benefits they want.

 

The same rule applies whereby Humana must receive the rehire notification within 31 days of the date of rehire  to be considered timely.

 

Rehired After 12 Months:

 

If a member’s rehire date is greater than 12 months from their termination date, the following rehire rules apply (in this order):

                A reinstatement or waiving of the group probationary/waiting period is NOT available. Thus, the member is enrolled as if they were a new enrollment and must meet a new probationary period. The 31 days rule for receiving the notification does not apply.
